AGB / General Terms and Conditions

These General Terms and Conditions apply to all services provided by Arkadiy Kuznetsov trading as Cubic Crew (hereinafter "Cubic Crew", "we", or "us") via the website cubiccrew.de. The terms are provided in English; the German version prevails in case of conflict.
§ 1 — Scope and Provider
Cubic Crew offers online exam preparation courses and intensive sessions for students at the Technical University of Munich (TUM), including Mathematics 1, Mathematics 2, Economics 1, Economics 2, Introduction to Data Science and Statistical Thinking (IDSST), and Exam Lab intensive sessions. Sessions are conducted via Zoom.

§ 2 — Formation of Contract
A contract is formed when (a) you complete a payment via the Stripe payment link on our website, or (b) you receive a written booking confirmation from us via email or WhatsApp following a contact form submission or direct enquiry.
By completing a purchase you confirm that you are at least 18 years old or have obtained parental consent.
§ 3 — Services
Group Courses (Essential & Complete)
Group courses run on fixed dates communicated at the time of booking. Course size is limited (up to 15 students). Upon booking you receive:
- Access to all sessions included in your package
- Full recordings of every session
- Session notes and materials
- WhatsApp tutor support for course-related questions
We reserve the right to reschedule individual sessions due to unforeseen circumstances. In such cases, a replacement session or recording will be provided.
Individual & Mini-Group Sessions
Individual and mini-group sessions are booked on a flexible basis. Session times are agreed directly via WhatsApp or email. Payment is due before or immediately after each session as agreed.
Exam Lab
Exam Lab is a focused 3-hour group intensive session held the week before the exam. Upon booking you receive access to the single Exam Lab session, a full session recording, and WhatsApp tutor support until exam day. Exam Lab sessions run on fixed dates communicated at the time of booking.
§ 4 — Prices and Payment
All prices are listed in euros (€) and are inclusive of any applicable taxes. Payment for group courses and Exam Lab sessions is processed via Stripe at the time of booking. Promotional codes (if applicable) must be entered at checkout and cannot be applied retrospectively.
For individual sessions, payment terms are communicated directly at the time of booking.
§ 5 — Right of Withdrawal (Widerrufsrecht)
If you are a consumer (Verbraucher) within the meaning of § 13 BGB, you have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days from the date of contract conclusion. To exercise this right, you must inform us of your decision by a clear statement (e.g. by email to ark.kuznet@gmail.com).
Exception for digital services: If you have expressly agreed that we begin providing the service before the end of the withdrawal period, and you have acknowledged that you will lose your right of withdrawal once the contract has been fully performed, the right of withdrawal expires upon full performance of the service (§ 356 Abs. 4 BGB).
§ 6 — Cancellations and Refunds
Group courses — cancellation before the first session
If you cancel your group course booking before the first session takes place, you are entitled to a refund of the amount paid minus the Stripe payment processing fee actually charged on the transaction. To request a cancellation, contact us at ark.kuznet@gmail.com before the course start date.
Group courses — cancellation after sessions have started
Once the first session of a group course has taken place, no refund is provided. Since you have paid for the full course, you retain access to all session recordings and materials for the entire course — including sessions you were unable to attend.
Exam Lab
Cancellations requested more than 48 hours before the Exam Lab session start time are entitled to a full refund minus the Stripe processing fee. Cancellations made within 48 hours of the session are non-refundable. You will retain access to the full session recording regardless.
Individual and mini-group sessions
Individual or mini-group sessions may be cancelled or rescheduled free of charge with at least 24 hours' notice before the scheduled start time. Cancellations or no-shows with less than 24 hours' notice will be charged at 50% of the agreed session price.
Refund processing
Approved refunds are processed within 14 days via the original payment method (Stripe).
§ 7 — Session Recordings
Session recordings are provided for the personal use of enrolled students only. Recordings may not be shared, redistributed, published, or used commercially without prior written consent from Cubic Crew. Copyright in all course materials remains with Cubic Crew.
§ 8 — Liability
Cubic Crew provides exam preparation support. We cannot guarantee specific exam results. Our liability for slight negligence is excluded, except in cases involving injury to life, body, or health, or breach of essential contractual obligations (Kardinalpflichten). In cases of essential contractual obligations, liability is limited to foreseeable, typically occurring damages.
§ 9 — Applicable Law and Jurisdiction
These terms are governed by the law of the Federal Republic of Germany. If you are a consumer, this does not affect any mandatory protections afforded to you by the law of your country of habitual residence. The place of jurisdiction for all disputes is München, Germany, to the extent permitted by law.
§ 10 — Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board and do not voluntarily do so.
§ 11 — Amendments
We reserve the right to amend these terms at any time. The version in force at the time of contract conclusion applies to your booking.
